Revive Energy Mint Franchise complaints:  Have you had any dealings with the Revive Energy Mint franchise opportunity or with its affiliates Sito Marketing LLC or RyLo Products LLC?  Please share a comment about your experience – good or bad – below, as well as advice for those considering a Revive Energy Mint franchise.

(UnhappyFranchisee.com) Revive Franchising LLC, based in Englewood, Colorado, offers franchises for the sale of its energy products through the use of vending machines and rack displays under the Revive trademark.  The total investment required for a Revive Energy Mint franchise is between $19,200 and $175,982.

Revive Franchising LLC began offering Revive franchises in March, 2010.  Its affiliate, Sito Marketing LLC, previously offered Revive Energy Mints as a business through business opportunity sales or seller assisted marketing plan arrangement for sale of their mints, along with vending and display equipment.  Their affiliate RyLo Products, LLC, manufactures the Revive Energy Mints.

A current company franchise advertisement states:

    I purchased a revive franchise in June and now I cannot get ahold of anyone there. My personal coach they promised me has dropped out of sight and will not answer my emails or return my calls. I do not know what to make of it. I am at a loss beause I was promised help but none seems to be available.

    I Bought a franchise about 3 months ago and everyone was great then all of a sudden they disappeared off the face of the earth! Did not notify anyone just went out of business. Call your credit card co.if that’s how you paid and they will charge them back.Good luck.Do not know why they closed down because the product is good.

    well it seems that the same thing has happened to me and my business partner we purchased a vending business from revive on Aug. 4, 2011 and we spoke with or coach a few times and haven’t heard from him since. i have filed a complaint with BBB and with Indiana Attorney Generals office on Sept 13th waiting to hear back from them in 10 to 14 days. I think Paul Haverstick ran off with our money.

    On Aug. 4, 2011 me and my business partner purchased a Revive Energy Mint vending business, We spoke with or coach 2 times after we got our vending machines and haven’t been able to get in contact with him since Aug. 16. So we are thinking the worst that they have closed up shop. So with that being said I have filed a complaint with the BBB and with the Indiana Attorney General’s office on Sept. 13, 2011 and we should here back from them in 10 to 14 days. I think they should refund everyone’s money and serve some jail time for ripping everybody off.

    I as well have put in a complaint about them to the BBB in September and they have put in a major complaint in about them. I don’t know what other recourse we have. Please keep me posted.

    It seems we are all in the same boat. I am not sure what happenned I have owned my franchise since Sept. 2010. Everything seemed to be on the up and up, has anyone contacted the FBI? It would be intresting to know how many of us bought into this and what they are trying to get away with. I have had 2 numbers that work, but they both have voicemails and I have left countless messages with no return calls as of yet. Please let me know if no own has contacted the FBI, I will start the process now.

    I came on board in July of this year. Everything was going well with the training. The last time I talked with Paul was when I placed my first product order on August 16. It arrived on August 23 so I called Paul and from that day forward through emails and phone calls there has been no response. I called the international Franchise Association in Washington DC and they investigated but found nothing wrong. There dues were up to date. Maybe the FBI can help. I don’t know. I have tried to recover some through my credit card but nothing yet. I wonder if there could be a class action lawsuit against them on an individual basis.

    Same story here. Tried to place an order and could not get through. I’ve contacted a couple of other franchisees and the story is the same with everyone. I spoke with a business owner friend of mine and he suggested we get together and pitch in to hire an attorney in Colorado to conduct an asset search, look into the corporate structure, who the principles are…

    I am having the same issues as everyone else. Last month I went to order product and the website was not up. I emailed Paul and he contacted me from a different number than usual, he told me there was difficulty through the website and he said he would place the order for me. I have had no contact since after making numerous attempts. Please keep me posted on any recourse so that we can be united and hold them accountable for their actions. There is way to much money that the franchisees thave invested to allow this to happen.

    Same story from Canada. I have been on board with Revive for 1 year now. All was going good except small things kept happenning which stopped me from going ahead. The latest was issues with Health Canada. Paul and the rep from Health Canada spoke and were in the process of fixing the problems. Then no more contact. Telephone number out of service, voicemail full and emails not being returned. Revive Mints are great and I certainly wish I could find out where in Canada the Mints were manufactured. Please keep me posted.

    Please everyone just take a few minutes and do this. I just talked with the FBI in Denver CO. They instructed me to tell everyone to go online to ic3.gov and file a complaint with the FBI. Then everyone needs to contact the Englewood Police Department at 303-761-7410 and also file a complaint. I am currently waiting on them to call me back so I can do so. I am going to tell them that everyone will be calling in and telling them they need to file a complaint against Revive. So they will know to have everyone talk to the same officer.

    Please remember that the complaint is on Sito Marketing not the product. Product was great, Sito Marketing Company is the Problem

    The FBI, the BBB or the police are not going to help us get our money back. We need to get a lawyer and go after the owners for their assets. I am sure they put away all our money! The FBI or police will just drag on for years, and we will probably never see any money. If we want quick action we need to get a lawyer and fast!

    We need to file a class action in Colorado asap. If the company is out of business, the BBB, FBI or the police aren’t going to get our money back. We need to hire a lawyer and go after their assets before someone else gets them.

    Darin is right, we have to get a lawyer together so they can take these guys assets quickly and get them back to us.

    I agree about the lawyer and the suit but we need a lot of people involved to share expences. I don’t even know how many distributors there are or how we can find out. Besides the names on this website I only know of Justin in KC and David in Phila.

    When I recieved my franchise documents there was a list of current franchisees included. I still have it but there are no phone numberes listed. Just name, city and state they are located in. I was able to track down some of the people by doing a web search because I wanted to hear what their thoughts of the company were before bought in. There are at least 30 names on the list but I’m sure some of them are not actively working the product.

    It only takes a few of us to hire a lawyer in Colorado and freeze these guys assets. If they really went out of business, then other individuals are looking to collect on them, we should act fast. They promised us lifetime coaching and we are not getting that. We need to find a lawyer in Colorado and take action.

    I think we should pursue them legally , I’m on board, long way from Denver here in Canada but whatever it takes to make them pay. I have some info that might help , I have filed reports with FBI and locall police but class action is what we need to do Logans real name is Colin Erdman also look at reviveright.com

    I think most of us like the product and can see it’s value in the market place. I’m most interested in having access to the product , the logos, trademarks… which is what I paid for. I don’t know who the manufacturer is but would be real interested in contacting them. If the product could be made available without the middleman mark up it its a step in the right direction.

    According to the current Franchise Disclosure Document (FDD) for Revive Franchising LLC, a number of management changes took place within the past 6-8
    months.
    Chris Robertson, the former COO of the defunct Kacey Fine Furniture, was named Chief Executive Officer and Chief Operating Officer of Revive Franchising LLC in January, 2011.
    The same month, Mike Kelty was named Chief Marketing Officer & Chief Strategy Officer.  Prior to that he was a VP of Sales for Summit Brick & Tile.
    William Wotochek was promoted to President of Revive Franchising LLC last December.
    Paul Haverstick served as Business Coach and Marketing Manager of Revive Franchising LLC.

    I am on board with hiring a lawyer as well. I too live in Canada. I have filed a complaint with the ics.gov site. Paul haverstick told me the mints were made in vancouver bc. I don’t know anything else about that.

    I too believe the manufacturer is located in Vancouver, it would be great if we could get the product for ourselves and cut out the markup. The new franchise document also says the previous management sold 100% interest in the company in January. It appears this is when the new management changes took place. These guys at a very minimum should be required to provide us with where we can still get the product. Has any one found a lawyer in Colorado?

    As soon as I determined that the company was gone I went to the retailers that I had signed up and pulled the product. I did this because of liability issues. I have no company to back me up should there be a consumer problem. I will see next Monday if the factory I am working with to place my first vending machine wants it. Most of the employees so far have had a positive reaction but I still hesitate because of the liability. Even if we can continue to get the product there is the problem with quality control. I feel somewhat safe with I product I have on hand. I did form my own LLC so I will check with the attorney to get his reaction about placing the product on the market.

    The same thing happened to me I became a franchisee at the end of July and had just gotten started when all of the sudden trying to get in touch with Paul Haverstick or Emma Burns to no avail. I spoke with Paul on August 22nd to get product and then found out later that August 23rd they went out of business. If there is a was for us to get our money back, lets do it.
    I think this the most despicable thing and something should be done about it. I also contacted the FBI in the St. Louis Mo. area and they say there is nothing they can do about it.

    I did go to the ic3.com website and gave them my information and I hope something gets done. You know the one thing about this is I spoke to Paul Haverstick on August 22nd to get some product and when it did not show up and I could not get in touch with anyone, I got in touch with a gentleman from Franchise Gator where I found the franchise opportunity and he told me that on August 23 (the day after I spoke with Paul) Paul Haverstick advised Franchise Gator that they were going out of business and did not need their services any more. One more thing you may find interesting, I did a search for Paul Haverstick’s phone number which I called and a lady answered and I asked to speak with Paul. The lady stated that she was renting the house from Paul and wanted to take a message and when I said is he Paul with Revive she said I really can not comment on that. SUSPICIOUS!!!!!!!!!!

    Researching this situation I uncovered that 5 fellow employees and associates at his previous employer American Vending Services are going to jail and being ordered to pay millions in restitution for vending opportunity fraud. The product was Buzz Bites caffeinated energy chews. Does anyone know the connection between AVS and Sito/Rylo/Revive? Same town, similar product via vending.

    Another interesting fact. From the franchise document William Wotochek the President, previously worked for The Dalbey Education Institute in Colorado. I researched this and it is another franchise scam that was shut down by the attorney general. I wonder if they are all connected. The revive product is a great product, it’s obvious the management have screwed everyone! Has anyone tracked down the manufacturer in Canada, maybe they could provide us with at the very minimum some answers? There can’t be that many candy manufacturers in Vancouver .

    The morning of 8/24/11 Chris Robertson filed a change of address for Revive Franchising LLC, Sito Marketing LLC and RyLo Products LLC with the Colorado Secretary of State.

    The new address is post office box: P.O. Box 4187 Parker, CO 80134

    This would seem to indicate both the premeditated nature of the abandonment and also the intention of continuing to do business under these entities if they are allowed to.

    I too have have contacted the Unhappy Franchisee and paid 125.00 USD. I think this is our best chance to recoup anything. The more franchisees that sign up, the better our chances are.

    I signed up with Revive as a franchisee over a year ago. I was promised by Paul Haverstick that if I followed the program, they would stick with me until I was successful. I couldn’t give those mints away. Everyone said they tasted like cow dung and Revive said it wasn’t there problem and they have this new wonderful formula. Stay away from these clowns. It’s the worst investment I have every made and the most time I have wasted. If anyone gets on a class action suite, or pursue a recoarse….please include me. I would love to see these con-artist brought to justice.

    Thanks Darrin for the great work in finding the Address change of Rylo Products. I just sent it to the BBB Denver CO branch. Filed a complaint with them a week or so ago.

    What are people thinking of going via unhappyfranchinsee.com or go via a lawyer ourselves.

    Also a comment was made about the taste of the Mints, and he could not give them away. Has anyone else had similar problems with the mints taste, and also are they the old or new mints?

    I have never experienced problems with the mints. The product is great. People enjoy the product. The problem here is the owners stole our money and left us hanging out to dry. They are scammers, they took our money and ran, there is no excuse. This product still has great potential.

I wonder how many of us bought a franchise in August or July, only weeks before they disappeared. What is in Parker Colorado, new office location maybe?

    My partner and I purchased a franchise in July 2011. We have experienced all the same issues mentioned above. I have contacted the ENGLEWOOD PD and discovered there is a case number #11-11051 on file. Everyone should call the ENGLEWOOD PD at 303-762-2460 and have yourself added as a compainant. This number is for the Investigations deivision and by early next week there should be a detective assigned.

    I have also experienced all of the same problems. I have been in contact with a few other franchise owner over the phone (darrin and jim). I am definitely in for any legal action we take and too agree we should act fast. Something needs to be done asap. Please keep me posted.

    We also bought into the franchise over a year ago and have had all the same problems noted above: placing machines, bad mint taste (old & new), service from company, only 1 or 2 coaching calls and unfullfilled promises of product commercials and advertising.

    Has an attorney been retained to file a class action law suite?

    I purchased a franchise one yr ago and i had the same problems placing the vending machines,did ok selling the eight pks of mints. I to am definitely in for any legal action that we take.

    I too am a victim of vending fraud, but with Mad Dog Energy Products and American Vending Systems. From what I have been able to figure out from a chat site Logan Chierotti, Ryan Russo (founders of Revive) and Paul Haverstick worked for American Vending and then started their own vending business opportunity. What you guys need is a site like we had buzz-bites-forum.com where victims can exchange information and buy product from each other. The American Vending people are now serving prison sentences.

    To all of you unfortunate people who were “scammed” by Chierotti, Russo, Wotochek and Haverstick – plse feel free to call me at [redacted] as I may be able to assist you with info and suggestions on how to proceed against these crooks!! You should also notify the FTC as well!! The FTC nailed “Black and Luckner” at Mad Dog energy and they are now in prison!! Make sure you have all the paperwork pertaining to the original “franchise agreement” you made with Revive!!

    Revive almost got my $13,000 back in Sept 2009 – before they started this franchising scam!! Actually they did get it – but I got it back after speaking with Logan Chierotti their President (Sito Marketing) – and reminding him I had certain info on him – that was embarrassing due to the fact that he had prior associations with Black and Luckner at “Mad-Dog” energy!! He knew I was going to be a problem, so he gladly reimbursed me – so I would “go away”!!

    I joined revive in mid august. I had to put everything on hold for a bit due to work but was trying to get in touch with Paul and emma yesterday and couldn’t so I stumbled on this. I see where some people are paying 125 to someone for a lawyer?? Haven’t read through all of this.

    There is an open investigation at the ENGLEWOOD PD case # 11-11051. Sgt George Clancy is overseeing the case and Detective Fast (sp?) is the investigating officer. Sgt Clancy told me on 10/11/11 that he has a letter indicating that the company had broken its lease at their known address and that the premises have been vacated. I urge everyone concerned to call the EPD and have yourself added as a complainant. Phone # 303-762-2460. Anyone with any other contact info for investigative agencies, please post pertinent contact info so we can act in concert to get some resolution. Also forward any information indicating FRAUD to the EPD.

    I did some research on the owner, Chris Robertson, and it turns out that he also put Kacey Fine Furniture in Denver out of business about a year ago. Seems like he shuts the doors on businesses he owns and disappears with everyone’s money. I think it’s also important to report this to authorities. He might have a scam going where he closes down businesses and runs with the money. We should look deeper into his track record.

    Does anyone have info on the other owner Mike Kelty? I couldn’t find much on him.

    The Denver Post said the head of the company died and her husband Sam Fishbein is closing it. It says “All customer orders and warranties will be honored.” I didn’t see any complaints about anyone taking money.

    The important thing here is to show that there’s a large enough group of victims that is unified and will actively participate. You’ve got to make their job easy for them.
    Secondly, it’s important to contact multiple agencies. For instance, it was the US Postal Investigation bureau and the USDOJ that prosecuted the Revive founders’ previous employer, and the USDOJ that brought the Red Bull/CCA scammers to justice. Because of the size of our case and multi-state lines, he suggested that this will be a federal matter.     Revive’s Franchise document says that Chris Robertson was the COO of Kacey Furniture. I called the BBB to see if they had information on Chris Robertson or Kacey Fine Furniture. They told me that Kacey Fine Furniture went out of business in 2010 and had a number of complaints against them as well.

    The Dalby Education Institute is listed in the franchise document under management also. The BBB informed that this company has over 200 complaints and is being sued by the attorney general. This is just a big group of scamers!

    “The Revive Energy Mints Rip off & Scam Coalition” is an example of a trick that questionable companies use to try to block/hide/bury negative posts about them on the Internet. They basically put up multiple sites, posts and press releases using their company name with the words “scam” and “ripoff” together. That way, when someone searches for “Revive Energy Mints Scam” they will see their bogus pages, not actual criticism. They are very good at this… I believe their pages still rank higher than this active discussion.

    RE: Detective Fast from the Englewood PD. The detective acknowledges that the PD isn’t going to do anything directly. However, they will forward complaints to the Department of Justice. That has some value, as the more sources the DOJ hears from, the better. However, a group is going to the DOJ and other agencies directly. Email UnhappyFranchisee[at]gmail for information.

    Yeah, the The Dalby Education Institute was one of those major real estate infomercial scams. There was an investigation and charges. They even prosecuted one of the women that gave fake testimonials.
    Yes, and some others on board were alumni of the Mad Dog Energy / American Vending Services scam under Gary Luckner and Richard Black (now behind bars).
    Unless they are stopped, many scammers take what they learn and start up a new scam and a new name. They get away with it when their victims are too ashamed/lazy and/or indifferent to take action. Hopefully, enough Revive victims will make enough noise to put an end to this particular cycle.

    The plan B is to continue business by selling the machines below purchase price and offer new improved healthy energy mint (NOT Revive) in various flavors once I finished all my remaining revive mints. I have been communicating with a reputable FDA approved facility in the past few weeks to supply me & other Revive victims a new product under new brand. Instead of just sitting here and waiting for the result of our action against revive group, I might as well do something with all my products before it expires. This way I can help create new jobs or help other people make extra money by buying individual machine and load it by purchasing mints (at least 3 flavors) at wholesale price. They can offer the vending machine direct to their employer or client – easy sell. Got the idea?

    I will say it again, I am not offering Revive distributorship nor sub-franchise. I’m offering Dalimara business opportunity. I do not have any intention now & in the future to use Revive name for personal gain nor to victimize people. I am still with the coalition against Revive and will continue to take action against Revive till we succeed.

    I think it’s pretty simple: Is the person being honest about what the buyer is getting for their money? Are you providing them with the same information you would want to receive if you were in their place?

    Revive promised you a nationally promoted brand, a ready supply of products, and unlimited coaching support. The brand is no longer being advertised, product is not available & your coach has skipped town. That’s a scam and you are trying to get them arrested.

    It’s not honest to sell your stuff with videos that talk about promotions and sponsorships, tell people they can get product from impressive websites in Colorado and fail to disclose that the product may not be available once the existing stock is gone.

    I don’t think it’s ethical to sell people on starting up a Revive business without telling them the real situation. You certainly didn’t appreciate getting duped.

    Good news! If you call the credit card company you bought the business with and show them you wernt given what you paid for, you can file a case number for a charge back and get your money back. The women said its important you can prove what you didn’t pay for, which in this case is easy since we paid for cnued support and product and we’re not getting that.

    Once the complaint is filed and reviewed you normally get your money back within 30 days? Has anyone tried doing this and succeeded? The women made it sound very doable.

    The credit card chargeback might be worth a try but it’s a longshot. First there’s got to be an active account to chargeback to. Do you think they abandoned the office and disconnected the phones but left your money sitting in an active account? Doubtful.
    If they are still around they could show proof that you received your machines & mints. CC companies deal aren’t going to deal with ongoing support issues.
    Best bet is contacting the dept of justice and ftc because they go after vending scams.

    I was the second posting on this website.I was just ready to make an order when they had their 25% sale and the website was up one day and down the next.I tried to get a hold of Paul Haverstick for days to see why the site was down? After no reply from PH I tried the main # and it was disconnected.At this point I knew something was wrong because PH always called me right back and I could not get a hold of anyone.I immediately called my credit card co. and filed a dispute.I was just under 90 days so they were able to charge back Revives acct.They gave me a 15k temp. Credit plus I disputed charges for a bunch of marketing materials also that are useless to me.

    I heard all of this as well. Talk to these guys, let me check your references. I bought in just over 2 years ago for $13,000. I got all 25 of my machines placed and sold very few because of their awful taste. When I tried to talk to my “coach” Paul Haverstick, I heard word-for-word what they recorded on their website. Over and over and over….I would just like to know where these people disappeared to. I have filed multiple reports and am considering joining this alliance. I would love to sell my machines if anyone is interested. Hope things turn our good for the rest of you.

    I was told that I could purchase these vending machines to sell energy mints and make a living without a nine to five job. I paid over $14,000 for the machines and product. I was also told that Paul Haverstick would be my coach along the way to make sure I was successful.

    Within the 3 day grace period of buying the machines, I expressed my concern that the area I lived was not conducive for success. Paul talked me into not going back on my decision. Shortly after I received the machines and product, I could no longer get a hold of Paul. He no longer returned my emails and calls. As I suspected, I could not be successful with this product in the area I lived. I was out 14 thousand dollars with nothing to show for it. I feel that I was scammed, and this was Paul and his teams goal all along.

    Reception to the product was fairly good and with all the website improvements, product and branding improvement, penetration into some better name retailers (if true), clothing with logos etc..this may have been one of the most elaborate and well planned scams as it went on for several years..is it possible that they just went out of business because they couldn’t capture more of the market against the big hitters like Red Bull and 5 Hour?..I paid $13,000 for 30 machines and various supplies..Paul seemed so earnest in his desire to help at the time ..I guess a sucker (me) is born every minute.

    I’m in a bit of a different situation than most. I bought 100 machines and a ton of the product for the machines from a person who didn’t want to mess with it anymore in March of this year. Once I paid the cash and picked up the machines and product, the seller signed over the franchise paperwork to me. I’ve more than made my money back, but I was called from another franchisee in my area and was told the news of Sito/Rylo going out of business.

    I suppose my major question is whether this scam is isolated to the owners of those who sold people their franchises or is it tied in to the manufacturer of the mints as well? This is a tangled web for sure and makes selling my vending company that much more difficult since I really can’t include the full revive franchise.

    I’d love to be a part of this class action, but I fear that I can’t prove any monetary damages. The most I would be able to do is give the confirmation of PH’s crap talk.

    Not to get too off topic or ramble too much, but once I’m out of the mints, I’ll be finding some other product to put into the machines. Adapt.

    I am a sucker that has been dealing with this LOSS for some time now. 2009 seems to be a good year from what I have read through thus far. My “coaching” experiences have always been filtered through to the smoothest talker they had, Paul. And no matter what scenario I shared with him (most of the problems were that NO one liked the product and b/c of that, NO one would allow a machine), he always stated that the product tasted great and that I need to pursue more. Keep trying. Really? I had one of the FEW businesses that allowed me to leave a machine with them say that they were SO embarassed and the people that would come to them in their lobby upset, spitting out the mints, and even had some swearing at them for having such a nasty thing in their business. So I had to remove the machine to spare any relationship with that business owner. The product is too strong. But my two cents (okay, way more than that) is the fact that I have been stuck with this product with no way out. And I have not heard from Paul in a LONG time. I have wanted out of this for some time b/c it never felt right the way I was being manipulated. I never considered myself a gullible person until this. This is my number one regret in life. If anyone wants to buy any product or vending machines, don’t hesitate to call. And I will be looking in to what more can be done for me as a suckered business owner. :-(

    I too purchased a franchise in January of 2011. I was reluctant at first after speaking with Richard Gates. He was very pushy and wanted me to make a decision over the phone after just talkingto him for 10 minutes. I told him I wanted to think it over and he kept pushing. That should have been my clue, but we’ll live and learn. I did contact some of the testimonial people they gave me and they all said this was a great business(THANKS GUYS!!!) After purchasing the franchise, I did get some of the coaching(if thats what you call it) to me it was a standard sales pitch training, from Paul Haverstick and started placing machines and going to the local convienent stores. The reception to the product was not very favorable and when I needed help from PH, he was gone. I was just starting to get some sales when in late August i couldn’t get any one at REvive to contact me.

    I have read the comments regarding Revive and I have a queation. Over 1 year ago I considered the Revive vending opportunity but I found another energy mint company in Winnepeg, Canada that was a lot cheaper.

    I bought 5 macines but have not been able to get any businees that would allow me to locate my machines.

    Could anyone suggest the type of businesses that have been successful locations?

    I received an email from the Colorado State Attorney office in response to my complaint and the respone was: :”Unfulfilled contracts are among the collateral damage in the closing of a business. However, there is nothing criminal in a closed business refusing to refund, or being unable to fulfill contracts. Only in rare occasions would such behavior be criminal, such as when a business knowingly sold contracts with the intent to close the business before the contracts could be fulfilled.”
    So basically it’s ok to scam people and get away with it because its not criminal. No wonder why these guys constantly get away with SCAMS, they are allowed too!!!
