We received the following franchise warning about the MATCO TOOLS franchise opportunity.  According to commenter “TOMMY CHEUNG” :

“STAY AWAY FROM MATCO TOOLS. THEY WILL SELL YOU A BILL OF GOODS,WHICH IS NO GOOD.

“RUMOR HAS IT ,MATCO MAKES MORE MONEY SIGNING NEW FRANCHISES THAN THEY DO TAKING CARE OF THEIR CURRENT ONES.

“DARYL PRITCHETT AND MIKE RAMEY WORK TOGETHER TO SIGN YOU UP AND THEN KICK YOU TO THE CURB. I AM WORKING ON A LAWSUIT AGAINST MATCO, HOPING TO TURN IT INTO A CLASS ACTION SUIT. YOU MAY CONTACT JERRY MARKS AT MARKS AND KLEIN LAW FIRM AT [redacted], IF YOU ARE INTERESTED.

“I INVESTED ALOT OF MONEY IN MATCO AND AFTER 3.5 YEARS THEY SHUT ME DOWN. WHEN THE ECONOMY SLOWED IN 2008,THEY PUT ME OUT OF BUSINESS.

“I ALSO SPOKE TO A PREVIOUS EXECUTIVE, WHO CALLED ME, AND STATED THATS THE WAY MATCO DOES BUSINESS. STAY AWAY FROM MATCO TOOLS AND RUN LIKE HELL WHEN YOU SEE THEM. I REPEAT DO NOT BUY OR INVEST IN MATCO TOOLS…”

Marks & Klein is a legitimate franchise law firm that often represents franchisees in lawsuits against their franchisors, but we haven’t verified with them whether a lawsuit against Matco Tools is in the works or not.

    oh my, taking what “THEY SAY” as gospel

    “Debbie you are such a LIAR, I just called Matco, once they charge you back they no longer collect on the PSA, now the rep couldn’t tell me about a letter and the supervisor I’d in a meeting, so later tonight I will waste 5 more minutes of my life answering a question for you.” uh huh – believe when I see it

    I DON’T LIE – PERIOD

    convenient, nobody knows what happens with the customer, HMMMMMMMMMM

    Because the CUSTOMER signed a CONTRACT stating THEY would PAY for the TOOLBOX – so, I wonder, WHICH CONTRACT COUNTS????

    The customer signed a CONTRACT stating they would PAY,,,,, so, clearly, if the distributor is charged back, a letter MUST be sent, SOMEBODY should know about this letter,

    There should be SOME PROCEDURE in place – as apparently this event is common………………..

    Don’t be getting judgmental with me – I just want
    ANSWERS TO A QUESTION

    Wow….classic Debbie you couldn’t do it could you. I did go to lady Matco ALL it is, is a bitch fest like your last post.

    So here is the answer to your question regarding 90 day charge back.
    Matco does NOT double dip as you put it, once they charge you back then they do not collect anymore money
    They do not send a letter to your customer, so it’s up to you to CALL your customer, let them know that you own the contract
    Then YOU have to collect the money
    If you don’t collect the money you don’t get money.
    I hope this clears up any confusion on your part!

    As you have so often complained about here, your facebook page, and also your website that “your customer service contact” told you to call or use the general email. Could that be a reason?

    STILL DOESN’T ANSWER THE QUESTION
    if the customer does NOT receive a letter, or a notification of some sort, well then, they would think they are to pay Matco – AS THEIR SIGNED CONTRACT BOUND THEM TO DO

    so, i am STILL DUBIOUS –

    no no no no, MATCO had the CONTRACT with the customer, if matco chooses to charge back the distributor then it would be MATCO’S RESPONSIBILITY to inform the customer

    Actually, If *** I **** took out a loan (just like my customer did with Matco)
    I would continue to pay the bank I took the loan from

    WHY would the customer think they have to the distributor???? Without some FORMAL notification from MATCO – the customer would continue to pay Matco as their signed CONTRACT bound them to do.

    You may wonder ‘why’ I’m harping on this but, THIS is just ONE point that needs to be clarified – Matco is more than willing to hold distributors to every letter of every word in their contracts

    Matco#1, you are in VIOLATION of your Franchise agreement. I suggest you cease and desist immediately. Maybe one of the current distributors on-line could forward this information immediately to the appropriate authorities.

    7.3 Conditions to Use of Marks. The Distributor will not have the right to sublicense, assign or transfer its license to use the Marks. The Distributor will not use the Marks as part of its corporate or other legal name, or as part of any e-mail address, domain name, or other identification of the Distributor in any electronic medium…

    After you buy tools, truck payment, insurance, phone, credit card service, fuel, MDBS Fee, Shipping expense, vehicle Licensing, Lawyer and Tax advisor fees,
    Office supplies, Truck maintenance, etc. … You got nothing left!

    Seriously, I know the business, one of the most interesting thing about this, You collect what you sell, you sell what you collect. For all of the work your doing, doesn’t sound so good. With Matco margins your lucky to get over 40%. As an Independent I can average 60%.

    But I have a feeling, your not living up to the letter of the Franchise Agreement.

    S – stories

    YES, when factual, accurate and correct – testimonial stories (FACTS) from actual distributors destroyed by Matco are not available – diversion tactics are the only thing that remains

    I have a question to all the people who love Matco soooo much, why are you sitting on this site trying to defend the company? Is what she saying offending or effecting you or your business? Or are you playing teacher’s pet with Matco? I will give you the fact that everyone is entitled to their opinion and can state it but saying she is a bad seed based on her expressing the frustrations she encounters often is pretty juvenile. I dare you to ride along with her on a daily route and maybe compare the experience to that of your own. I guarantee it is very different.

    MoparMandi, no one here is defending matco but rather lies that people are trying to make up ABOUT matco. Everyone’s experience with matco is different. It’s a business and what you do with it is totally up to you. If someone was trashing your name, your brand, your lively hood on here would you be so passionate?

    Guest17, you don’t know me.

    For all active distributors reaching their 10 year anniversary – Matco will have to have a sit-down with you at least 6 month prior to renewal. During that meeting they will ask you if you intend to renew, if so ‘sign here’, If NOT sign over here. I signed with the intention to renew. The DM then proceeded to tell me I’m not eligible because of purchase average. I asked if Matco cared at all about the economic situations that we are faced with, he basically said no.

    So I had to make a decision, try and make the goal that Matco made for me, which was not my goal – or separate.

    After further consulting with family, Lawyers, fellow distributors and customers, as well as Matco Executives, it was clear what I had to do.

    Six months prior to expiration of my contract I stopped buying Matco. Why buy from someone that was not willing to work with me or support MY Goals.

    Some business partner, no consideration for death, health or economic times.

    I won’t go into the rest of the details. My suggestion – Talk with your Lawyer, understand your states franchise laws and STOP ALL Communications. SIgn NOTHING. Document the FACTS surrounding your situation, let the Lawyers handle the situation and do what you have to do.

    Now, time has passed and I am sorry I ever dealt with a company like Matco, not because of the business they are in, but because of the management – TOP DOWN.

    As I stated earlier today/late last night. Matco lacks integrity and the ability to deal honestly with their business partners.

    We distributors live in a world where Matco District Managers tell us one thing and do another.

    Where route surveys are fabricated and head counts inflated.

    Where one distributor can go where ever he wants and others can only go where Matco wants him to go.

    Where District meetings force you to buy tools you don’t need.

    Where when you ask for help you get rejected.

    Where MDAC meetings do nothing.

    Where Distributors have everything to lose and Matco just pockets the money.

    If Matco is here to help us I’d prefer you to give examples how.

    Not just get on here and antagonize and provoke the very air I breathe.

    I wish Distributors had a relation of integrity, honor, loyalty and commitment with their DM’s.

    But I live in an imaginary world where peace and harmony cannot coexist between Distributors and DM’s.

    With some recent activity in the district, a route survey was required.

    Why would Macto send a ‘Business Manager” from over 100 miles away to do a survey that the local DM could have done?

    The report was that the Survey was totally *F’d* up because the guy had no clue of shop locations or the towns.

    Matco is up to something… I think your right Matco1, something smells…

    condense your route, stay overnight – INSTEAD OF DRIVING 140 miles to start where you finished the day before

    CONSERVE fuel costs – work 10-12 hour days – 4 days a week, instead of wasting the diesel on a truck that only gets 8 miles to the gallon

    How can you afford to only put 40 to 48 hours a week in.

    I drive 550 miles per week and have to put in 60 to 65 hours per week to get it done..And how do you handle the freight if you are gone for 2 days??
