A Chronology of a Failed Franchise:
Mary Patrick shares the details of how it it took 22 months to open her Cuppy’s Coffee franchise, and only 8 months to close:

Cuppy’s Coffee and its previous and related entities (Java Jo’z, Emerald Coast Manufacturing, Elite Manufacturing, Medina Enterprises, Medina Management, Specialty Coffee Coop, and now FranSynergy) have been prolific and controversial producers of unhappy franchisees throughout their few years of existence. This small company has created a nearly unprecedented crop of unhappy franchisees under the Java Jo’z, Cuppy’s Coffee and Elite Manufacturing entities. Many franchisees were “preapproved” for financing from the company and gave Elite $30K – $52K “refundable” deposits. When they were unable to secure funding, Elite refused to return their money. Those who did get funding and a location have worse stories of construction delays, lack of support, and individual losses of approaching half a million dollars.
Criston Menz writes that she’s been trying since March, 2007 to get the $35,900 refundable deposit Cuppy’s Coffee owes her.

Robin & Corey Rivera have been trying to get the $30,000 deposit they gave for a Java Jo’z since 2006.

    Hmm, Dale started this same thing of an ‘ask question’ forum on BMM last year, but then stopped posting/answering questions and left it up to others to answer.

    Why it takes 6 months for this to be the answer is beyond me. What are the odds that he answers any tough questions on this thing? My guess: zero. The first question that should be asked is ‘How are you going to get the company out of this mess?’

    I am sorry for rambling on, but as I think about this, I guess I only have myself to blame for our own downfall. I should of been less naive, and not trusted people who treated you so well at the beginning. And then dumped you like a bad habit. Think about all those youngsters you talked to on the phone, when you were trying to get an answer to something. None of them have any experience. I were simply yes people. They were getting paid nominal wages based on nominal educations. Morg hired people to answer phones and pay them the least amount he could in that small town of Ft. Walton Beach, which makes its money on tourism. Anyways, the blame starts with me and then goes on and on from there. I never thought I would make a decision in business that would affect my life in such negative ways. Marriage, money, financial security. Its all gone now. I wish I never would of met these people and Morg who is nothing more than a slick talking salesman. I am sorry for all of your hurts and negative experiences this has caused. Sometimes I just want to die. Its that bad. I wish all of you the best.

    okay, okay MR>DALE wants to improve communication. This is what he needs to do. . How about letting us know when he is planning to re- pay all of us. This page is not going to make things better we are to angry many of us have already gotten lawyers not until he takes care of this HUGE PROBLEM is when people will start to respect and improve what we say here. He needs to talk to us the VICTIMS and open a line of communication with us we can not even call cuppys nobody anwers the phones voice mails are always full. Yes Dale open communication dozes of us are very MAD, ANGRY come on get real solve this communication problem first then maybe people will actually take you serioustly.

    Well the 7-10 days of personal phone calls is just about up. Did anyone get their 1:1 call to go over their individual situation? Or was sending a 120 question survey supposed to take the place of communication?

    I’m sure all the franchisees are more than happy to fill out an introductory questionaire to explain who they are, what they paid, what they would like to see happen, and which millenium they’d prefer to have their Cuppy’s Coffee branded business open.

    Here’s the real question. What is the purpose of the survey? Is it anonymous, or will he know who is saying what? Will he use that to determine which franchisees get more help than others (ie if you are more positive, you’ll be helped first).

    I’m sorry to say to all of the Cuppy’s victims that you will NOT be getting re-paid. The company has NO money and I wouldn’t be surprised if their next step is filing for bankruptcy. Since the company has NO assets to liquidate to re-pay the victims they will all be out of luck. Sad, but true.

    Hang in there! We also had to file for bankruptcy and lost a lot at the hands of Cuppy’s/Medina/Elite. I refuse to let it get the best of us. We will not allow them to take our dignity along with everything else they stole from us. Keep fighting for what is rightfully yours and don’t give up on yourself!

    Medina renewed most of the domains as recently as this month. Most are registered til 2010. Anyone know why they’re down?

    I have my worst nightmare with this company (cupp’s coffee &more = Fresh synergy Inc.) moved to a new locatoin (Alabama) to avoid their vendors and cover up their corprate scams
    Back in December 2006, I got un solicited call from Cupp’s coffee franchise
    manager to offer me an “opportunity “to own the so called fast growing franchise in the world which is a nightmare,to be part of their family and I was promised they would do everything they can to make me grow with them as a franchisee, they showed me false testimonials to sign me up. After they checked my financials and collect my deposite of 20% for the cafe size shop, I started finding out what a fraudulent, cheat franchisor they are.
    I would never recommand anyone to get into this ever knowing what took place.
    They did not deliver what they supposed to , the have my deposit, I also
    sent several request e-mails, attoney drafted demad laters they did not respond.
    to my attorney. Thanks to this forum, I could express my frustrations.
    I have all evidences and still waiting for my deposit back.

    Just wondering if anyone knows of Kristen (spelling?) who trained Cuppys for openings. I know she worked at Cuppys and would travel to openings and help train franchisee’s employees. She helped train my crew.

    She was to open her own drive thru in VA or Wa DC and I was just wondering if she got hers open.

    We are probably the oldest Java Joz /cuppys contract still in business although we are no longer associated with them. Those rat bas…s took our money and gave us the same blues everyone else went through. However we came through it in better shape than most because we acted a natural fool. When they got through with us they just wanted us to go away and we did, We took a new name and they never held us to their franchise. Frankly they could not find the paper work – we lucked out. Yes we still lost money and probably will never get it back but we have been in business now for about two years. Glad to tell our story.

    Just in case they didn’t read the book “Masters of Deception” or hear about the alleged insurance scheme in Arizona.
    Just in case they aren’t familiar with what happened to those who invested in Slender Lady, Java Jo’z or Cuppy’s.
    In light of all of the wrecked lives and lost savings to come out of those stories, a little alleged domestic violence certainly won’t tarnish his image.

    If Admin is on that train, he has plenty of company and I call dibs on a window seat. Morg was in charge when portions of my money intended for buildout of my store instead was allegedly spent on “operations”. It didn’t get spent on my store buildout as the invoices stated. There are plenty of people who are waiting to confront Morg in front of a courthouse. Or in a courtroom.

    These 3 men have ruined lives and committed crimes. Glad I don’t have to answer for their sins when they have to stand before God.

    As much as I’d like to take credit for that, ADMIN posts as ADMIN. You see, I like to get credit for every bit of Morg-bashing I contribute. But if I have a protege, I’m proud. Just like Morgie must be proud of Dale Nabors.
    Alicia & Claudia are right – the Morg-bashing train is packed. If you’d like to know why, try reading through the interviews linked to above. That’s not the train that’s heading to hell.
    I’m sure Morg is misunderstood and it was just coincidence that hundreds (maybe thousands) of people lost significant money in the companies NAV listed that he was was running. Please share your thoughts on his track record.
    Does he, like Dale Nabors, run into burning houses valiantly trying to save the occupants… only to be maligned by those he tried to save?
    Do you really think someone is kind and caring because he offers free daycare and employs his relatives… all with stolen money?

    The Cuppys down the street from my work just renamed their store to Java Coffee or something like that. The main thing is that It is good to see that people are moving on.

    Well it looks like the gang is all still here. Happy to know I never have recouped a penny but finally decided to take the loss on my taxes this year. I will never get back what we gave him, but I am a firm believer in Karma, and it will come…have faith you angry followers, it will catch up with the Cuppy’s and Java gang. Health is good, family is excellent and the economy is still kicking my butt, but life is good. I don’t need to have $35,900 in my pocket to tell me otherwise. I have what is important and honestly, I could not ask for a darn thing more. Now if I happen to recoup…well then that is just gravy on top and we can discuss that at a later time. In the mean time, I certainly appreciate all of you who still are following and hoping to seek justice. I believe we have all done our part and can only hope that justice will prevail sooner or later. As for today, the outlook is good, with or without a cup of coffee in hand.

    It appears this has all come to an end. We were all duped out of our money. I pursued Cuppy’s and Elite legaly. Won my case in PA. However, try to collect the money from a ghost company, now. No attorney in collections will take the case. I can only hope Florida Attorney General, FBI, IRS, somebody, will go after these people personally and put them in jail. I can only hope to hear that some day. Our money is gone and so are Cuppy’s/Elite. The money is somewhere, maybe. But we will never see it.
    Sean, thanks for all you have done for your efforts. I have an expensive piece of paper saying Cuppy’s/Elite owe me money. Good money after bad. God knows we did not deserve this, but it shows one how easy it is to scam people out of their savings. Very expensive lesson.
    Christon Menz, we tried, we failed, to get our money back. Will NEVER happen getting our deposits back. I pray they all die of a horible disease associated with Cuppy’s/Elite..
