CUPPY’S COFFEE FRANCHISEES CALL DALE NABORS

Cuppy’s Coffee franchisees and Elite Manufacturing who have deposited tens of thousands of dollars that the company refuses to return claim they are not going away. The individuals are calling Cuppy’s Coffee owner Dale Nabors, hoping to find out when they can expect their money returned.
If not satisfied with the response, the individuals are reportedly planning to file complaints with the Better Business Bureau, the FL Attorney General, the Attorney General of their home states, the FBI, the Federal Trade Commission (FTC), The Small Business Administration (SBA), The International Franchise Association, as well as other governmental, consumer, and media organizations.

The individuals are also appealing to Cuppy’s Coffee franchise owners, Java Jo’z licensees, company vendors, lenders and even customers to help urge the company to give back the money rightfully owes to those who trusted refundable deposits with the company.

If all else fails, the group will consider a national boycott of all Cuppy’s Coffee and Java Jo’z outlets nationwide.

    Trinity: It looks like some of the franchisees who are open are only open because Cuppy’s had the stolen money of these depositers to work with to get their stores open.

    Shouldn’t the franchisees try to exert some pressure on Dale Nabors to get these people their money back so that they don’t have to resort to a public boycott? They just want their money back.

  • Some of the current franchisees have to know there is a problem because they’ve had problems with the build-out process. A franchisee in my area has already said on Cuppy’s forum that it was easier to forge ahead & open, rather than try to get a refund.

    When you’re able to get away with something once, what stops you from getting away with it again? Support from the franchisees would be great for us. It could also unite and solidify them, keeping Cuppy’s from trying something illegal with them down the road. What’s good for one is good for all!

    There are several groups of franchisees.
    1) There are franchisees who opened Cuppy’s or Java Jo’z and have closed
    2) There are franchisees who are open and struggling to survive
    3) There are many franchisees who are stalled in the construction phase. Some are paying rent & loan payments, but their construction is stalled by Elite/SBT. Some are having liens put on their eqpt by SBT because of lawsuit.
    4) There are franchisees – such as yourself – who are owed refunds of tens of thousands of dollars that Cuppy’s/Elite never should have spent
    5) There are an estimated 50-100 or more franchisees who have given deposits and are looking for real estate or trying to get funding. They have no idea that all this is going on. You will be seeing them here in the months to come.

    Meanwhile, Morg Morgan is reportedly in Florida, sporting a nice tan, driving his Jaguar or cruising on his Harley and living large in a rented (read: asset free) seaside condo in Destin.

    Guest: 5-10 of them would have to come up with $3K – $5K each before any firm would represent them. No one would take this on contingency… not even Quick, Duhk & Hyde. The problem won’t be winning… it will be collecting.

  • If you have the “good” franchise agreement I think it’s section 8.18. The signed franchisees need to get organize under this section and push forward.

    Lawsuits are expensive and cause people {franchisees} and businesses {Cuppys/Elite} to go bankrupt in the process.

    Call the AAFD (I think the guys name is Bob Purvin; sorry I don’t have my paperwork with me at the moment working off of a very stressed brain at the moment) to learn more about getting organized under Section 8.18 of your franchise agreement.

    The AAFD is the last place you should look for assistance with Cuppy’s Coffee. Bob Purvin is the franchisor’s advocate – he even gave Cuppy’s coffee a fair franchising award despite all the people being cheated out of their deposits. Even after the last wave of cheated investors, Bob Purvin was singing and laughing with Cuppy’s President on stage at the AAFD meeting, and even had him, Doug Hibbing, hand out the next year’s award.
    As far as I’m concerned, the AAFD has aided and abetted this franchise fraud and helped them lure more franchise depositers in with their meaningless award.
    The AAFD and Bob Purvin have lost major credibility over this issue.
    In fact, one commenter has suggested they rename the organization AAFD&C: American Association of Franchisees, Dealers &Cuppy’s

Most of the small population of FWB and surrounding areas have worked for Cuppy’s/Medina at some point, including some radio DJ’s. Cuppy’s/Medina? Problems? This is old news around the area.

    When you chose to own a Java Jo’z instead of converting to a Cuppy’s, that was a choice you made, and you have absolutely nothing to complain about. You wanted to be a licensee, and run own business your own way, so you should’ve done it instead of whining. I believe I heard your store was closed long before Mr. Nabors came into the picture, and I also believe you were offered help when you FINALLY called someone back.

    I would say, feel free to go out and picket, but what would that solve? Dale Nabors has been busting butt trying to get people taken care of, and sorting out the mess left behind from the lack of previous ownership. I realize that you all think you have been patient long enough, but that’s not his fault now is it? From what I hear, more people are receiving their previous monies back now than ever, but they aren’t going to be the people out blogging and telling people how now that ownership has changed hands, things are moving in the right direction, now are they?

    Are you talking about the Dale Nabors saw the opportunity to take over a corrupt company with no cash down, signed an agreement to continue to use SBT, defaulted on that agreement which prompted a lawsuit against Elite Manufacturing and liens on the franchisee’s assets?

    The same Dale Nabors who is making promises of opening dates that are still being missed?

    And can you name these people who are supposedly being given partial payments of their own money? That’s cause for celebration? It’s my understanding that DN worked as a consultant with the company for over a year, was privvy to all Morg was doing. I guess I’m missing the part where he’s the savior here. Please explain.

It doesn’t do much for you. Also, I promise you, not one person who has ever owned any asset of the companies has a daughter named Trinity. So get your facts straight before making accusations.

    In response to Admin…you don’t get the whole story, because most of the people who work for the company are pretty closed lipped about what goes on. Maybe Dale was there consulting, but I assure you, I don’t really believe he was “privvy” to as much information as you think he was. If you haven’t met the man, talked to the man, and heard about how he feels, I don’t believe it’s fair to question the man’s integrity. As much as you all may feel this is one big scam, and no one gives a damn, you couldn’t be more wrong. The man cares, he doesn’t want anyone to fail, or lose everything. I guarantee you, that isn’t what he wants.

    Dale was a consultant there for a year at least, correct?

    If he took over all the liabilities of a troubled company without making sure he had all the facts, he might be honest, he might mean well, but he wouldn’t be very smart, would he? That wouldn’t make him a very astute businessman, would it?

  • I was told that Federal charges were served to Dale Nabors yesterday. Does anyone know the particulars? Does this mean we will be getting our money back? Did it have anything to do with him not paying his employees and stealing from them? I understand there have been numerous resignations because of his dishonesty, and cowardly way of meeting with and following up with franchisees. Would be very interested in what happened yesterday when he was served with the Federal charges.

    Please allow me to set the record straight since you seem to know about me and my Java Joz. First and foremost, I was getting screwed already by Morg and his sidekick Lou the lawyer. I called the company several times prior to my closing trying to get some help of some sort. I finally recieved a call from some teeny bopper hired by Morgan saying….”Hey how are sales…..” Obviously completely oblivious to my many prior phone calls or emails. When I explained that business was poor and I was getting no support as Morg had promised when he acquired the license’s from “dont drop the soap” Snowden. By the way, if memory serves me, those calls came about 3 months after I reached out. Well, to make a long story short…Dale Nabors called me and said “hey, we are working on things to help your sales”. I replied to Dale that I have approx. one month left of funds and I will be facing bankruptcy. I also advised that I was looking for a buyer. “Well…we will help you become profitable”! Some more time past…and I called Dale and could not get a return call. Two days before closing my business, the same teeny bopper called and said…”maybe we can help you sell your store”. So, if you want to call me a whiner..go ahead. If you want to call me a bad business owner…go ahead. If you want to put Dale on a pedestal…go ahead. I talked to the man personally. Empty promises and blah blah blah is all I heard. This is America and you can say whatever you would like to short of slander. But unless you have owned your own business, busted your ass, spent money for advertising, paid an employee so maybe, just maybe you could get a few hours sleep nd spent a little time with your family, you are in no position to judge me or anyother business owner. Unless you can show how you took the chance on YOUR own business, your comments are null and void and insignificant.     Dale Nabors is one of the best and smoothest liars I have ever met. He just like the last management team should all be put in jail. He lined his pockets with hundreds of thousands of dollars, moved the firm, up and left everyone holding a bag of his bs. I don’t know if Natalie was aware of his shennanigans, but if she was, she should be in jail with herhusband. Too bad they don’t allow coach pocketbooks in jail.

    Dale’s future is close to over. While I don’t feel sorry for him, I do feel sorry for Natalie and his children who believed in him as many others did. The only thing he proceeded to do was give a lot of people false hopes, people who like himself have families and homes to support and he bankrupted some of them. The blogs about him show how really shallow he is to tell people at coffee college that Natalie knows the difference between the fake and the real. That’s not true, she married him. So if she wants a real man, she should call me and my partner, we’ll show her REAL MEN who live by their word and they can be trusted.

    I think he’s a rank amateur compared to Morg. Morg wouldn’t have pissed everybody off so quickly and effectively.
    He almost goes out of his way to alienate just about everyone.

    Methinks he bit off more than he could chew. Maybe Morg’ll repossess the company, bring it back to FWB, and hire everybody back.

    Of course, he’ll just repossess the assets, not the liabilities, and blame it all on Dale Nabors.

    I can imagine the AAFD press release now: “From the ashes of a previous company, Morg Morgan leads the new Cuppy’s Coffee with spirit undeterred…”

    Please note this video was done well over 2 years ago. I started when Roy was over Java Jo’z and was in the same position as many are today, afraid of losing everything. We were luckly and were able to open our stores and are still open and profitable. When Morg took over from Roy I had high hopes and things really looked liked they were going well. I did this video as a testimony because I love our business and to this day believe in the concept. At the time I truly believed that Morg was going to make a go of this company. When my family lost everything after Katrina except for our store, they were there for us offering to help or bring products to us should we need them. When anyone called about the business I was always honest with what I knew, told them my stores did well but could not promise them theirs would do the same, tried to not give out numbers because there is no guaranteed that because one store is profitable that another one will be. I was never paid anything to talk to anyone as a referance. I was and am greatly disappointed in how things have turned out and my heart goes out to all that have been unable to open there stores. I picked our locations and have worked very hard to make them successful and knew up front that if they failed I had no one to blame but myself, however I was fortunate enough to be able to get my stores open and given the opportunity to succeed or fail. My husband, son and myself work our stores everyday and work hard to keep them successful. I have no idea how things will turn out in the end, I have very little contact with the offices since I am able to operate my stores on my own and always have. I can only pray for all those concerned. In the meantime if you do not know an individual yourself you should not make false comments about them. I also know that Martha is a good person and would never do anything to hurt anybody either. I hope that for all the stores that are open that they are able to be successful in spite of all the blogs, I will keep you in my prayers also. If I knew how to get this video off you tube I would since this is an old video that was at one time on the old Cuppy’s site but is no longer.

    Dale Nabors and his lies are damaging to the franchise industry. I know that for every Dale there is a greater number of good guys who do the right thing for their franchisees and employees. Unfortunately the perception that Dale has put on the franchise industry is very negative. Does anyone know yet if the Fort Walton employees were paid?

    Hello Dale,

    It is disheartening to find yet another player in the Cuppy’s saga unable to follow through with his word. We, in our naivety, sat across the table from you as you told us ‘you would do everything in your power to get us open’. We set a date and time for a conference call as we graduated from Cuppy’s College. No phone call from you, and no longer available anytime all week due to meetings, no return email. Rumors abound, we defend the righteous man who assured us he had our best interest at heart and that he was responsible for the $125,000 we had given Elite. We told you of our lack of ability to pay our August rent and our loan payment. Not to worry, you would help us find a solution.

    We have exhausted every effort to obtain financing through the lenders recommended by Steve at Elite as well as have gone off on our own to try to obtain our own financing to no avail. At this time we are choosing to exercise our right under our agreement to a full refund of the funds deposited to Elite:

    9. IF SUBJECT TO THIRD PARTY: This document may be subject to Purchaser obtaining a commitment for financing; if so, then Purchaser must exercise due diligence, as determined by Elite, to seek and obtain such financing. In the event that Purchaser is unable to obtain financing, then this agreement shall automatically terminate, neither party shall have any further legal obligation hereunder and any down payment tendered shall be returned to Purchaser; EXCEPT THAT Elite shall be entitled to retain from any down payment any direct or indirect costs incurred, including but not limited to engineer drawing cost, plan costs, change orders, administrative expenses and any other expense paid or advanced by Elite. The remaining balance of the down payment shall then be returned to Purchaser.

    I expect a full refund of all monies paid. As you said in our meeting, the FSM’s are nothing more than cheerleaders, the Elite girls are just secretaries and the architect is a joke. He was given a full set of plans by us and did nothing to them. If you have any integrity at all you will remedy this situation.

    I believe Cuppy’s has an exceptional product to offer consumers. I thought the training program was great. The training process allowed us to get excited again about our venture, however, I see no commitment by Cuppy’s or its key players to get us up and running. By the time everything is said and done, you will have a great new corporate headquarters, and franchisees who are broke and homeless. I hope you and your family can sleep knowing that you played a role in the demise of hundreds of innocent people who just wanted to become financially independent. Not to worry! I am sure your kids and your wife will be resting quite comfortably at our expense. Grow those college funds!

    PS: I have done the ‘wheel of life’ and have a perfect circle around 0! I have no money, no time with my children/husband because I will have to work 100 hours a week for God only knows how long to pay off all the debt I have incurred at Cuppy’s expense, I have no spiritual life because at this time I have no faith that a decent, good business man exists, I have no mental health thanks to the turmoil you and your lovely company have put us through!

    Except that Rickey and I will be working 100 hours a week in our independant coffee shop that we build ourselves with no thanks to Cuppy’s.
    Yes, Dale, hope your kids pick a great college with our $146,000. I didn’t realize I was sending my sons and Dale Nabors children all to college!!!

    Last I heard, Dale was stringing the Ft Walton employees along with promises that the check would be there tomorrow, the next day etc….He even used the old “I’m waiting for a wire transfer” trick on them. He is one classless piece of work. I am calling the Fransynergy offices and asking to speak to him, perhaps if enough shake the tree maybe just maybe he will come clean and take care of promises and obligations. Might not be a bad idea to call TV news stations in Florida and Alabama to see if someone would like to do a report on unpaid employees, broken promises, broken contracts etc….

    Latest Update…. The sky has fallen on Dale Nabor’s Dream Team in AL. Dale has finally gotten up enough nerve to meet with the employees that followed him up to Muscle Shoals, AL and told them he can NOT get the money to pay them. But he wanted to know who would continue to work for him for FREE. Has he lost his mind totally? He also told them if they would not stay and work free he did not want them to blog him. WTF????!!!!! He’s an arrogant sh it!! So… now there are NO employees at Cuppy’s/Elite/Medina! Dale is still trying to sell Elite contracts to Brian Hayes. But remember franchisees… Brian Hayes/SBT or whatever name they go by these days is overcharging you for buildout and equipment. Your best bet is to take whatever loss you have now and sue Morg/Dale/Medina/Fransynergy and try to recoup your deposit moneys. Cuppy’s is dead! Even if a franchisee let SBT continue to build them out, I would NOT call it Cuppy’s. Cuppy’s has an awful name and I don’t even think God himself can raise that dead franchise. Franchisee please listen up… you need to join together to get justice. There are more people out here willing to help you get that justice than you may think. Good luck to you zees and to the employees that followed Dale to AL and had work for 2 months without pay. I wish you all well.

    Guest & screwed franchisees…. you keep talking about Dale Nabor and yes he deserves to face criminal charges but don’t forget Robert “Morg” Morgan. Most of those bank disbursments happened under Morg’s watch. Morg was the main person pushing the banks to disburse before they were suppose to. They both need and hopefully will face criminal & fraud charges.
