On his The Sanctuary promotional blog, his bio makes it clear that women are Morgan’s new target:

Morg’s latest approach appears to involve making himself seem sincere, sensitive, vulnerable and non-threatening to women through his declarations of celibacy and his willingness to share his truly awful poetry.

In Celibacy 2009 The Right Reason, Morg aka Rawman writes:

As a celibate raw vegan, I still have the same temptations and desires that face every man; however, the difference for me, for the first time in my life, is that my physical desires are subject to my spirit and the truth that is the very essence of my creator whose very essence is love which abides in me and makes me a new creature moment by moment renewing my soul. My creator reveals all things to those who are patient, kind, truthful, unselfish, trusting, believing, hopeful, enduring, not jealous, boastful, arrogant, rude, selfish, or angry. I now know true love never fails. I exist for love exists and I know that nothing is more important than love and I shall abide in it and it in me now and forever. Amen.

Nothing warm’s the cockles of a woman’s heart – and loosens her pursestrings – like love poems so syrupy they could gag Rod McKuen.  Perhaps Robert “Morg” Morgan’s most terrible offense to humanity so far is his Rawman’s Not-So-Famous Poetry:

Who would guess that the Rawman, the cancer survivor, dedicated raw-food advocate, celibate, women’s health guru, father and really, really bad poet would be the Robert Chrysler Morgan whose unethical insurance dealings landed him in the book “Masters of Deception,” whose involvement with Slender Lady, Java Jo’z & Cuppy’s Coffee franchise and business opportunities left literally hundreds of lives and families financially and emotionally devastated?

Yes, Robert “Morg” Morgan has skated through the Cuppy’s Coffee fiasco and, while the last struggling coffee shops close, is pitching his oceanside seminars as the goofy but loveable Rawman Walking.

CUPPY’S COFFEE: Mechanicsburg, PA Cafe Closes

Cuppy’s Coffee of Mechanicsburg, PA closed its doors on July 13, 2009. Our condolences and best wishes go out to the Cuppy’s Coffee franchise owners Jason & Joanne Winters and their son, Jason. mechanics3.1

The Winters opened their Cuppy’s Coffee cafe January 24, 2008 and energetically promoted their cafe with lively events and live music performances,  including a musical appearance by American Idol Kristy Lee Cook. On their Cuppy’s Coffee & Catering website, the Winters write that it just wasn’t enough to sustain their business:

Shortly after opening we noticed a downward trend in our walk in business do to a rough ecomony and had to find another way to bring in income to keep the cafe open. We started to offer catering to local businesses for their luncheons or dinner events. This helped keep our business afloat for awhile, however, the economy was still in a bad situation and so were we.

We had to make a decision whether or not to continue keeping the doors of the cafe open or close and continue our catering in another location. Ater much thought we decided that we would have to close the cafe, a sad event for us but one that we had to make financially.

We are now focusing strickly on catering and will continue to grow this portion of our business.

Despite paying a franchise fee and receiving a promise of marketing, operational and purchasing support, the Winters were abandoned by the Cuppy’s Coffee franchisor Medina Enterprises, which disappeared in a cloud of allegations & controversy.  Like many Cuppy’s Coffee franchisees around the country, the Winters were left to fend for themselves with none of the support they paid for.  And also like many Cuppy’s Coffee franchisees, they were unable to build a sustainable, profitable business despite their best efforts.

Please join us in wishing the Winter’s much success with their catering business and all future endeavors.

CUPPY’S: Benefield’s Get Press

Cuppy’s franchisees and their outraged supporters continue to be dumbfounded by the inaction on the part of any government or law enforcement agency despite widespread Internet coverage and calls to action. It continues to be inconceivable that no one is taking action despite tens of millions of dollars lost and hundreds of families who lost their investments in franchising’s version of the Madoff scheme.

Yet some of the scammed Cuppy’s franchisees refuse to give up, and continue to shine the media spotlight (ok, media flashlight) on the Cuppy’s scam in the hopes of justice. Alicia & Ricky Benefield’s efforts continue to pay off with articles such as this one in the Carrollton Times-Georgian: Carrollton coffee shop owners say company took them for $168,000.

“I’m going to do everything in my power to send [Nabors] to jail,” Alicia Benefield said. “It’s that important.”

CUPPY’S COFFEE: Who’s Suing Them Now?

Commenters at UnhappyFranchisee and franchise site FranchisePick.com have posted the contact information for preparing or considering group action suits against Cuppy’s Coffee, Medina Management, Elite Manufacturing, FranSynergy, Morg Morgan and/or Dale Nabors and associated entities.  The first two are leading franchisee law firms, the 3rd is a FL personal injury firm said to be “looking into” a possible action.

CUPPY’S COFFEE: Ochsenreiter Sues Medina & FranSynergy for $132M

    A lot sure can change in 7 months.
    In that amount of time, Medina was purchased by Dale Nabors’ Fransynergy, Ochsenreiter was reportedly let go, the staff was cut, the company is beseiged with lawsuits, and Medina’s final contribution to the local economy was renting the trucks to move the Home Office to Muscle Shoals, AL.

      Oh, and Donald Ochsenreiter sued Medina & FranSynergy for $132,306,000.

      Doing a quick search on the name, it appears that this is the former CFO and Exec VP of the company. Also looks like he is demanding quite a bit of money. No documents have been filed at this time.

      CUPPY’S COFFEE: Dale Nabors’ Private Conference Call

      Friday, October 3rd, Dale Nabors held short, invitation-only conference calls with two groups:  unhappy Cuppy’s Coffee franchisees who have opened, and unhappy Cuppy’s Coffee franchisees who have not yet opened.  There was no conference call for the third group:  unhappy franchise depositers whose $35K – $100K+ refundable deposits Cuppy’s Coffee/Elite Manufacturing felt free to spend on other things.

      Reportedly, Dale’s bold action plan includes actually talking to the franchisees whose financial futures are teetering on disaster.  According to Jim:  “The Cuppy’s corp office will be in touch early next week to begin scheduling calls.”

      Of course, Dale reportedly blamed the “negative blogging,” in part, for the current situation (perhaps signaling a new Fransynergy motto:  Believe, Shut your Pie Hole, and Succeed).  Attendees immediately heeded his plea with negative blogging.

      Jim writes:

      It lasted about 15 mins. He said he felt like he failed particularly in the area of communication. (Really? nah…) He and the corporate team (team?) are going to work at responding to calls and emails on a more timely basis.
      I think I heard that Dale said he is working with their banks and the franchisee banks to attempt to restore confidence in the brand. He requested a stoppage of negative blogging to give them some time to move past where we are today.
      He hopes to announce that the SBT suit is resolved sometime next week. He intends to meet with each franchisee re: where they are in the process and what they need to get back on track to opening the store.
      The Cuppy’s corp office will be in touch early next week to begin scheduling calls.
      And then a bunch of stuff about how we need to work together to make this the best specialty coffee brand in the US.

      He’s asking people to stop the negative blogging, but people have heard that before when they signed their ‘refund’ agreements, and things quieted down until they stopped getting paid.

      Current and prior management has brought this onslaught on themselves. People that haven’t opened their stores yet need to look at the economics of the situations. You could take the $40k loss on your current investment and open independently, and you would probably save $50k on the buildout. Your $10k ahead already.

      Both previous owner Morg Morgan and (less effectively) current owner Dale Nabors seem to be proficient at remaining in the background while their "executives" sign documents, send the uneasy memos, take the difficult phone calls… and incur the wrath of cheated franchisees.  As head of the entity that was used to exchange many people’s life savings for broken promises, missed deadlines, unreturned refunds, and bankruptcy, Executive Vice President of Elite Mfg, LLC, Theresa St. Clair has certainly attracted her share of wrath.  But was St. Clair part of the problem, as some have suggested, or well-meaning person who was pushed to the forefront of the battle wearing a bright red target?

      St. Clair’s defenders have pointed out that her much-maligned email to franchisees (Cuppy’s Coffee / Elite Manufacturing Infuriates Franchisees With Form Email) was sent under her signature without her permission.  One "Guest" came to her defense recently by posting this comment, which includes her resignation letter:

      Arod……Theresa NEVER promised anyone anything!!! She always referred them back to their agreement. There was a handful of contracts that she added a statement about “if refund was requested… they would get a refund within so many days”. That statement which would have been very few of was included in contract ONLY if Morg Morgan or Ben Doyle told her to put it in there.

      If someone did request a refund it ALWAYS went through the legal department which was handled by Danny Jones. Danny Jones ALWAYS tried to bully people into settleing for less refund money than what they paid. Theresa doesn’t have a new vehicle like Amy Hiller and Robine Donlon. She still drives the same vehicle when she first started working for the company. If anyone should be investigated here along with Morg and Ben and Dale, it would be Danny Jones because he’s been with the company sinced Roy Snowden’s Java Jo’z days.

      Hell, if the zees want someone to testify on their behalf they should talk with Theresa. She use to be VP of Elite sales until Morg threw her into the Elite Ops division against her will because she told Morg & everyone that she knew nothing about construction but Morg put her in there anyway last December. After being in the Elite Ops for a few months she began to realize that something wasn’t right and voiced her concerns with Morg & Ben who continues to tell her and other employees that everything was ok. Theresa kept seeing that the zees were NOT getting built out as promised nor were they getting their cabinetry or equipment, etc… At that time Dale was a consultant and he also kept telling her it was going to get better & asked her to hang in there.

      She hung in there for a few more months & then Dale bought the company. T was so excited about what changes would’could be happening because Dale promised so much, etc… Unfortunately after 3 months of non-action on Dale’s part to get things moving for the zees, she had enough & put in her letter of resignation which I just happen to have a copy of. I believe this show what Theresa’s values are:

      Dear Dale,

      Before you bought the company, we had several talks about the lack of ethical and honest behavior with the previous owner and the direction of the company and what needed to happen in order for it to truly be successful. I felt we saw eye-to-eye.

      You bought the company approximately 3 months ago. I believed you could and would turn this company around and be on the up and up with the employees and franchisees. Meaning…start operating this organization ethically, honesty and with integrity. The first month I was impressed with your actions.

      Unfortunately, your actions these last few months which include the total absence of any communication from you to your staff in Florida, have made me question your character, your honesty and your integrity. I also no longer feel that you have the franchisees best interest at heart. You have accepted more money from franchisees and you are not delivering their equipment, cabinetry and furniture.

      Therefore, please consider this my letter of resignation effective immediately. Let me know when I may pick up my last paycheck for last week or will it be direct deposited?

      If Terri or Lori has any work related questions for me I will help them as much as possible.

      CUPPY’S COFFEE: Attorney Rudy Harper & Assistant Desiree (Reportedly) Resign

      It’s been reported that Cuppy’s Coffee in-house attorney Rudy Harper and Desiree Kahn, the Cuppy’s Coffee legal assistant in charge of handling refunds, resigned Wednesday, September 10th.

      Harper and Kahn reportedly stayed behind in Ft. Walton Beach after a limited number of employees were invited to relocate to the new home office in Muscle Shoals, AL. Not receiving a paycheck and a lawsuit from the landlord over nonpayment of rent are likely factors in their abrupt departure.

      One commenter on Blue Mau Mau wrote:

      The last attorney left is Lou. Is he even allowed to practice law in the state of Florida or Alabama?

      With all of the legal issues Cuppy’s is facing, perhaps it should have been high on Cuppy’s priority list to at least pay their attorney his paycheck.

      CUPPY’S COFFEE: Vendors, Landlord, & Clients Feeling Scalded, Too

      Is there anyone NOT furious with Dale Nabors, Medina, Cuppy’s Coffee, Elite Manufacturing, ETC.?

        jd writes "Looks like Medina’s former landlords have sued for ‘non-payment of rent’ and were starting evictions proceedings.  The suit was filed two weeks ago and they were a little late.  Also, San Gelato Franchising Corp is suing Medina, Dale and Morg in Okaloosa County as well.  Not sure what their complaint is, but it was just recently filed too.

      Medina, parent company of Cuppy’s Coffee and Elite Manufacturing, reportedly convinced Fort Walton gelato manufacturer San Gelato to develop a franchise program to be administered and expanded by Medina.  The lawsuit is likely in regards to Medina’s abandonment of the program once the company was sold to Dale Nabor’s FranSynergy.

      I am an employee for one of Cuppy’s vendors. Cuppy’s has owed us around $10,000 for many months. When we contact Cuppy’s regarding the amount owed, they inform us (when we arent sent to voicemail) that "the check is in the mail" or that "the check will be released on Friday." Suprise, Suprise.. we have never received a check.

      I notice that people state that Cuppy’s (under Morg) took people’s money and used it for something else. Well, I am here to say that I believe it is still going on today (under Dale). We continue to receive orders from Cuppy’s franchisees (who have already paid corporate for their products) and then Cuppy’s corporate is unable to pay us for the products delivered.

      It seems as though Cuppy’s corporate is taking that money from franchisees that should be used for products, and spending it on other things.

      Beware what you order from Cuppy’s.. Even though you pay for it, you may not receive it because they do not pay their vendors!
