It’s been reported that Cuppy’s Coffee in-house attorney Rudy Harper and Desiree Kahn, the Cuppy’s Coffee legal assistant in charge of handling refunds, resigned Wednesday, September 10th.
Harper and Kahn reportedly stayed behind in Ft. Walton Beach after a limited number of employees were invited to relocate to the new home office in Muscle Shoals, AL. Not receiving a paycheck and a lawsuit from the landlord over nonpayment of rent are likely factors in their abrupt departure.

Dont kid yourself. Those of us no leases, those with signed leases, and those with current build-outs are still screwed. I see nothing changing and would not get hopes up that anything will change.
We went through that up-down emotional rollercoaster for a year.
I just talked to a florida employee and he told me that his inside information has Dale,Morg and Brian Hayes working together to try and scam the banks into disbursing more funds for the buildouts.He also said Dale is trying to get Caffe D’e Arte and Figaro bros to invest into this fraudelent company.Somebody should let these companies know that Dale has no intentions of moving forward.I think he is structuring his exit which is why he is asking for more time from everybody.The more time Dale has to manipulate the more it is costing all of us.
I’m just amazed that this company thinks that they can keep everybody’s money and nothing is going to happen to them. They have messed with the wrong person. I will get my money back if it is the last thing I ever do. I worked to long and hard to make my money to have these pieces of sh– take it from me. I will see you soon Dale you piece of SH–.
So, now Dale is working with Morg and Biran huh? They’re boarding the Alabama Dream Team. Wow who would have thought you would ever hear of that trio? I smell a rat!!!! A rat looking to score the cheese. That $27 million in SBA loans just keeps flashing before their greedy little eyes. Nevermind the lives that have been effected and destroyed over the situation thus far. Let’s take it a bit further. What could be better than 3 con artists working together to get every penny they can? These guys are a joke! First they take thousands of dollars from all the franchisees. Then they scam their now ex employees out of their last pay checks. Now their at it again. They don’t care who they hurt or have already hurt. Do you think Dale has once reached out to anyone that he has screwed over in the past 6 months lately? Not a peep. He is one of the biggest cowards I have ever met in my life. I regret that I ever believed in this man! As I am sure everyone else who may have feels. I do feel bad for all the franchisees and all the ex employees who were drug into this mess. Morg and Brian took this company to the edge and gave it a slight nudge and Dale took it crashing down. It’s one thing to fail, it’s another thing to be a failure and a coward. Dale put on quite a show for a lot of people for a long time……….we all see through you now Dale. We see all the ugly that you forgot to mention for the first year you were with the company. I feel sorry for all the employees who are still backing you up thinking that you won’t do the same thing to them that you have done to all of us fighting for our stores and all of those who you left in FL. You’re not a man at all.
When does it end. This is ridiculous? This scam has to end sooner or later. One day the employees who still seem to be there will go to work and the doors will be closed. Dale is a coward. A coward who will betray anyonone to get what it is he is in seek of. I mean wasn’t he the same person that was talking so much negativity about Morg and Brian and now he is going to work with them? Some morals Dale some morals. Looks as though the hole of greed has sucked you in too. Karma will see to it that you get what you deserve. Just leave well enough alone. You have told so many lies that you don’t even know what the truth is anymore. You don’t even know who you are anymore. It’s sad. The number of lives you have ruined. And lets not get started on the fact that anyone who has ever believed in you, you have betrayed. Some man you turned out to be huh? Probly not anyone that we would want running the company anyways.
We all need to start working on our own solution.Those of us that are waiting on our buildout need to look into the option of going independent.There are construction companies out there that can do your buildout for half of what SBT was doind it for and if you are waiting on equipment my contact in florida says Dale/Morg was marking up the equipment at least 40-50%.You will save a lot of money purchasing your own equipment.Even if you stay with Cuppys now is the time to stop both Cuppy’s and SBT of overcharging us all for our project.Dale is not in a position to try and uphold any contract that was signed so from here on out we need to dictate to him how our project gets finished.As for the ones that have put all the money into the company already you will need to go to Alabama immediately and don’t leave until Dale/Morg?Brian puts a check in your hands to get you up and running.If he says he doesn’t have it then be prepared to stay a few days until he gets it.If you let him get away with stringing you along again and leave Alabama without a check then Dale’s scamming has worked on you again.If you have money left in an SBA loan DON’T disburse the money to these crooks.Tell your banks what the history of Dale/Morg/Brian/SBT is and after you get your project finished then start dictating to these crooks what fair price you will pay.If you need help with some of the costs my contact in Florida has all the actual costs he can give you.As for you ex employees/employees you also need to go to Alabama either as a group or individually until Dale takes care of your pay issues.Be prepared to stay until Dale pays you.I for one am going to start taking control of the situation and Dale will not be calling the shots from here on out.I will!!!

It’s funny how just a few months ago Dale was running around spreading the word about how devious and coniving that Brian and Dale were. He turned all his franchisees against them and even wanted all the zees to leak every ounce of information they knew about Brian and Morg. Now now, the shoe is on the other foot. Dale must have realized that the only way he is going to get any money from this is to scam the rest of the zees right along with Brian and Morg. What makes him think that anyone in their right mind would give the three of them any money. That would be the dumbest thing anyone could ever do. Dale wasn’t concerend when it was others lives he was ruining. Now that he is close to ruining his own life…………he is joining forces with the devil. Let the best man win.I once heard that Dale had stated there would be about 20 stores which would need to be sacraficed through this mess for the better of the company. Some of the higher up managers at Medina were concerned about this new consultant coming on board & investigated/called Dwyer Group. Their comment was that they did remember Dale but that he NEVER AMOUNTED TO MUCH & WAS LET GO. That should have been a RED FLAG for Morg at the time. But I guess not. Dale has proven to be an absolute weasel & coward! He tells people such bull (this includes zees, s-employees, current employees, media) that I believe he truly believes his on crap! WHAT A JOKE THIS SO-CALLED MAN HAS PROVEN TO BE. I truly feel sorry for his family. Another fact that I found out is…Dale is on these blogs daily defending himself as other people. THIS IS A BONAFIDE FACT! I know that Robert Morgan is no angel by any means, but next to Dale Nabors…Robert is Gabriel coming down from Heaven in all his Glory! Robert Morgan never stole a penny from anyone. He might have borrowed from Peter to pay Paul, but never did he steal or lie or committ FRAUD like Dale Nabors did. Mick: This claim should be fairly easy to substantiate. Can you provide links to some of the allegedly phony blog posts? Cuppy’s Coffee has a grand tradition of fake blog posts and maintaining dozens of phony propaganda blogs. They are fairly easy to see through.

I’ve been watching these posts from the sideline for quite some time and finally decided to chime in. First, let’s all be honest with each other that both Morg and Dale and first class scammers. Morg with his pushy sales style and Dale with his believe and succeed crap. There is NO question that they have conned and scammed, however, it is unclear whether they have committed any crimes. I love how franchisees and former employees, without any evidence, claim that Morg/Dale are going to jail. Just because you gave them money and didn’t get your refund back or your buildout done, doesn’t mean that they have committed a crime. They have breached the contract and would be liable for damages in civil court, but the only lawyer that i’ve seen chime in here is Michael Webster and i haven’t seen him say that crimes were committed. I feel bad for Criston Menz, the Riveras and others, but they have a civil NOT criminal action. BTW, there is NO money in either Medina or Elite, so filing a civil suit is just a waste of time and money because when you win, you won’t be able to collect.
As for crimes by Morg or Dale, did they take deposits from franchisees and put it in the operating accounts, instead of the buildout accounts; YES. Did they take money paid by banks and put it into the operating account; YES. As these crimes? NO. If they submitted fraudulent invoices to the banks, that’s another story. But, the way the disbursement worked was that Elite got 20% when the franchisee signed the agreement with Elite, 40% from the bank upon receipt of building permits and 40% upon receipt of C of O.

Sean, you talk about Morg’s Jag, Condo, etc. First, the Jag is like 5 years old. Second, it’s not like he was living in some multi-million dollar South Beach condo. It was a little “hotel like” apartment. This guy didn’t get rich off of the backs of the franchisees. Unless he’s got some swiss bank account, Morg didn’t lead the life of the rich and famous. Where did the money go? How about $20,000 per month for beach front office rent, 125 employees and a cleaning lady that made more than i did. Let’s do some simple math. If the average employee was paid $35,000 and there are 125 employees, that’s about $4.5 million. Add in rent, sales commissions, operating expenses, etc. and you can see how the expenses quickly get out of control. So let’s guess that the total expenses were $6 million per year and the average franchisee put up $35,000 to Elite, Morg would have to sell about 15 new franchises per month. He clearly wasn’t doing that.

So your defense of Morg is that he is not dishonest or engaged in fraud, but it just appears that way because he is an unbelievably inept businessman who does not have a clue about cost-management, budgeting or human resources?
I guess that’s on interpretation. Legitimate franchise companies consider their royalty stream their primary source of income. Why would a franchisor who does not receive – nor ever has received – a dime in franchise royalties incur $6M a year in overhead? Are you saying Morg Morgan, an experienced franchisor, is completely clueless about business?
Why would he need an expensive beach front office to support franchisees? Why would he need 125 people? Another interpretation would be that he built an expensive – but effective – big show in order to sell franchises and collect fees. There wasn’t even a royalty collection mechanism in place – which one could interprete as meaning that there was no real belief that these units would be successful long term anyway.
It’s odd how these defenses of Morg Morgan, Dale Nabors and even poor Bob Purvin end up being “He wasn’t dishonest… he was inept.” Neither seems too flattering.
As far as not being criminal… I’m no legal expert but if someone shows a pattern of deception and takes large sums of money promising one thing and not delivering… how is that not theft? How is that not fraud? How would someone not be liable, personally, for criminal charges?
I am one of the many who lost their savings to Cuppy’s and Elite Manufacturing. I follow these blogs in the hopes that something positive and helpful will come about. Instead I only seem to be reading this gossip that does not really help anyone. This site is here to help those of us who lost our money to these companies. We should be sharing any information we obtain and helping each other come to some kind of resolution. Maybe there is no solution but if there is even a chance that there is one out there I think we should be concentrating on that. Anyone who has lost money to these companies should do the interview with Sean so we can get as many complaints posted as possible…maybe that will make a difference.
Morg & Peggy did not get divorced. I just saw them together the other day & she has been with him in the AL meetings with Brian Hayes & Dale all last week.

Let’s get as many interviews and stories up as possible, then put forth a concerted effort to email the link to as many relevant parties as possible.
If nothing else, we can help a lot of others learn the same valuable lessons all of you have. If you’re a PO’d employee, provide some details as to how and what happened, what was told to the banks and SBA especially, and were all these people’s money went.

Oh Admin, the mommy blog was posted during the fisrt month that Dale bought the company. After that first month her MOM no longer feels that Dale has done a damn thing positive. The “mom” resigned months ago.

I am in the process of getting all the facts to my attorney regarding my speceific fraud allegations against Dale Nabors.I have been working with Steve in finance to get his testimony of the fraudelent invoices that he says he was told by Dale to create to send to the banks so that the banks would send the money.He also told me that Dale told him that the money being sent by the banks was not going to be used for projects but rather was being used to finance the move to Alabama.Steve [after some coersion ] has agreed to let me post his e-mail address so that anyone wishing to contact him looking for specific information you would need for your fraud allegations against Dale he would give you all that he knows. First off, I never defended Dale Nabors.
That’s pretty obvious, but nice try.
Pointing out that he did not mastermind this magical misery machine, but took over the controls from founder and architect, Morg Morgan, is not defending Dale Nabors.
Saying that he is foolish, not stupid, is not defending Dale Nabors.
Saying that Dale Nabors’ taking over this company may indicate he’s foolhardy, or greedy, but not a coward, is not defending him.
It’s just stating the facts as they are. I have no dog in this fight so I’m free to simply call it like I see it. That’s pretty clear to any rational reader.

However, the “guest” ranter (the one whose elegant language includes “LIAR, FRAUD, PIECE OF SH*&, A-HOLE, SPINELESS, YELLOW, SICK, GOING TO JAIL…” etc.) clearly has an agenda: to wage an attack on Dale Nabors as the sole villain and scapegoat, and thereby diminish the obvious culpability of Morg Morgan and his merry crew.
Why would someone be working so hard to defend Morg Morgan? My guess is that it’s either Morg himself, a close family member, or, most likely, an ex-employee helping to set the tone for the triumphant Return of the King. Yes, like the little monkey with the fez, one of the self-righteous ex-employees who still longs to get the crew back together and sail on the Black Pearl once again.
The history of Cuppy’s Coffee is an ongoing creation of myths: The diligent Morg taking over from the misguided Snowden, the well-meaning Morg building a dream company but perhaps caring too much, the loving Morg entrusting his company to his scheming first mate, and, (coming soon to a phony blog near you!) the return of King Morg (I’m getting chills!), to banish the darkness, right the wrongs, judge the living and the dead, drive the weasels and stoats from Toad Hall and restore the Glory that was Cuppy’s!
Is this good drama, or what?!
Homer, Ovid, Aeschylus and Shakespeare got nothing on these folks’ ability to spin a yarn. It’s a whopper – but they believe in the ultimate stupidity and/or self-deception of those they deal with. No offense, franchisees, but they figure a a bunch of you were stupid enough to trust them in the first place, then stupid enough to buy their ongoing excuses to this point, and that enough of you are stupid (or stupidly hopeful) enough to buy into the “Cuppy’s brand” illusion and the “Dale Nabors caused all this” sham to let them get away with another chapter.
And employees? They know most of the ex-employees have an ethical on-off switch with two settings: Getting Paid and Not Getting Paid. As long as it’s set to Getting Paid they’ll justify anything and everything. Hence, the Golden Age of Morg.
Friends, Pirates and Zees… in my humble opinion, the truth is that this was never a viable company, never had the potential to be a viable company, and never will be a viable company.
“guest” can make all the adolescent insults, unsubstantiated personal attacks and phony comments he/she wants (please do it elsewhere), but it can’t change that.
In the meantime, guest, lose the profanity, add some substance and get out the Strunk & White book you never opened in your single semester at Junior College and maybe you’ll continue to be tolerated on this website, my website, a wee bit longer.
‘GET REAL’ Guest on October 9th, 2008 9:35 pm Anyone who portrays that Theresa St. Clair, self appointed “Executive VP” (she added the ‘Executive’) of Elite Mfg., has one ounce of “integity” or is “honorable” in any business capacity either doesn’t know any REAL facts, is totally ignorant or may be rooming with her. She flat out lied to prospective franchisee’s and very knowingly deceived many out of their money for the sake of her “commissions”. She was one of the first to turn on Robert Morgan, the man who hired her when she had lost everything (all those great CURVES franchises), as soon as she knew he was leaving, and stuck her nose up Dale ‘the Donkey’ (being polite on this one) Nabors Parade to Nowhere, and then, when even Dale obviously saw a wasted salary in a minor league ass kisser, subsequently tried to resign with “integrity” (there’s that word again that she wouldn’t even know how to spell, yet know the meaning of) when she knew she was being FIRED! Although her talents are those of a middle mngmt. “clerk” at best, her coveted title and position of responsibility to those that were investing money in the Cuppy’s family certainly warrants outright fraud & deception and WILL reunite her and the Donkey and possibly others in a Correctional Facility. It just can’t come fast enough. There is substantial evidence that has been submitted “under the radar” that will support the facts above & below and will surface soon enough to the watered-down satisfaction of the unfortunate franchisee’s that “believed” Theresa St. Clair when she told them in plain english about selling her CURVES Franchises (rather she LOST – as in CLOSED) to buy her daughter a CLUSTER of Cuppy’s Franchises because they were such a great money maker! People that were on the fence of going with Cuppy’s or not BELIEVED her and those statements prompted them to invest their money! Not to mention her (Exec. VP) statements directly to the new franchsee’s that their money would be placed into an Escrow Account, etc., etc., etc. THERE WILL BE JUSTICE! She can’t ’sue’ her way out of this one, her standard mode of operendi! She’s going down & doesn’t even know it yet! Somehow, not surprising! By the way, in case anyone hasn’t realized, the majority of the statements in this blog that “support” Theresa St. Clair…. are WRITTEN BY THERESA ST. CLAIR under different names!!!
Re: Get Real… You must be mistaken. The ONLY person that has/had their nose stuck up Dales’ butt is Amy Hiller. You are also mistaken in regards to TS “Losing” her Curves clubs. It’s a public fact that she was at the time she sold he Curves clubs the “Top franchisee” out of 2,000 nationwide. She then went on to open her own chain that did very well. She had been away from curves a good 4 years before she ever met Morg. So you obvioiusly don’t know what you’re talking about & you have show that you obviously have a beef with TS! TS was definently not fired. Dale wanted to keep her on but she did not like what he was doing after the first month. Once again “Get Real” needs to get real & get a clue.
